1. Who we are
footsie ("we", "us", "the Platform") is an online community where adult users share photographs of feet and rate them on a 1-10 scale. By creating an account, uploading content, or otherwise using the Platform you ("you", "User") agree to these Terms of Service.
2. Eligibility (18+)
You must be at least eighteen (18) years old — or the legal age of majority in your jurisdiction, whichever is higher — to create an account. By registering you represent and warrant that you satisfy this requirement. Where age-verification statutes apply (including but not limited to Utah SB 287, Louisiana Act 440, Texas HB 1181, Arkansas SB 396, Mississippi HB 1315, Montana SB 544, North Carolina PAVE Act, Virginia SB 1515, and Idaho HB 498), you further represent that you meet all applicable verification requirements. footsie is strictly SFW and is not intended to be an adult-content platform, but we enforce a hard 18+ minimum out of caution.
3. Your content
You retain ownership of everything you upload. By uploading, you grant footsie a worldwide, non-exclusive, royalty-free license to host, display, resize, and distribute your content solely for the purpose of operating the Platform. You warrant that you have all necessary rights to grant this license and that your content does not infringe any third party's rights.
4. Prohibited content & conduct
- No nudity, sexual, or otherwise explicit content — footsie is strictly SFW.
- No content depicting minors, ever. Zero-tolerance policy; we report to NCMEC as required by 18 U.S.C. § 2258A.
- No content of a person other than yourself unless you have their written consent.
- No scraping, harassment, hate speech, doxxing, spam, or promotion of illegal activity.
- No attempts to circumvent moderation, safety, or payment systems.
5. Community Guidelines & moderation
Our Community Guidelines are incorporated by reference. We may remove content, suspend accounts, or refuse service for any violation, at our sole discretion. Repeat infringers of copyright will have their accounts terminated in accordance with our DMCA Policy.
6. Payments, subscriptions & tips
Paid features (Pod Member, Sole Elite, Boosts, Custom Badges, Tips) are processed by Stripe, Inc. under Stripe's own terms. Subscriptions renew automatically until cancelled; you may cancel at any time from your account, in which case access continues to the end of the current billing period. One-time purchases and tips are non-refundable except where required by law. Platform tips carry a 15% platform fee. Prices, features, and taxes may vary by jurisdiction.
7. Termination
We may terminate or suspend your access at any time for violation of these Terms. You may delete your account at any time; some information may be retained to the extent required by law or for legitimate security purposes.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY, INTEGRITY, OR QUALITY OF USER CONTENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, footsie SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY IN ANY MATTER SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, OR USD 100, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless footsie and its affiliates from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your content, your use of the Platform, or your violation of these Terms.
11. Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis (no class actions), except that either party may seek injunctive relief in court for intellectual-property matters. If arbitration is unenforceable in your jurisdiction, exclusive venue is the state and federal courts of New Castle County, Delaware. Residents of jurisdictions where such clauses are unenforceable (e.g. certain EU/UK consumer protections) retain any non-waivable rights afforded by their local law.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be announced on the site. Continued use after changes constitutes acceptance.
